Read these Terms of Use (“Terms”) before visiting or using trademysocials.com (the “Service”).

These Terms govern access to and use of TradeMySocials and apply to everyone who visits or uses the Service.

By accessing or using the Service, you agree to be bound by these Terms and comply with them. If you do not agree with any part of the Terms, you must not access or use the Service.

About TradeMySocials

TradeMySocials provides an independent marketplace for exchanging social media pages.

Buyers and Sellers use the Service to publish listings, communicate and follow the required transaction facilitation process.

By accessing or using trademysocials.com, you agree to be bound by the terms and conditions set forth below:

  • TradeMySocials is not an auctioneer;
  • TradeMySocials does not sell Digital Assets on behalf of Sellers;
  • TradeMySocials does not grant full completion of the agreement between the Buyer and Seller for the sale of Digital Assets;
  • TradeMySocials does not grant the accuracy of the information provided by the Buyer or Seller;
  • TradeMySocials is not responsible for what happens to the Digital Assets Seller and Buyer at any time;
  • TradeMySocials is not a Party to any agreement and is not responsible for any actions or lack of any Seller or Buyer.

The Seller and Buyer conduct all negotiations and make all offers between themselves.

TradeMySocials can help resolve disputes between the parties by using the TradeMySocials Escrow Service, but TradeMySocials cannot monitor and guarantee: the availability, quality, safety and legality of the Digital Assets added; the veracity of the information provided by the Seller and Buyer; the Seller’s ability to transfer a Digital Asset; the Buyer’s ability to pay for a Digital Asset.

Definition of Digital Assets

In these Terms, “Digital Assets” means only the social media groups, pages and channels offered for purchase or sale through the Service. Engagement and manipulation services, including likes, followers, views and comments, are excluded and are strictly prohibited.

Acceptable Use

You must not use the website in a way that damages it, could damage it, or reduces its availability or accessibility. Unlawful, illegal, fraudulent or harmful use, purposes and activities are prohibited.

You must not use the website to copy, store, host, transmit, send, use, publish or distribute material containing or linking to malicious software. This includes spyware, viruses, Trojan horses, worms, keystroke loggers and rootkits.

Systematic or automated collection of data from this website is prohibited.

This includes:

  • Scraping
  • Data mining
  • Data extraction
  • Data harvesting
  • ‘Framing’ (iframes)
  • Article ‘Spinning’

Do not send or transmit unsolicited commercial communications through any part of the website.

It is also prohibited to:

  • Use the service if you are under 18 years of age
  • Create more than one account on our service
  • Create a new account after blocking the previous one
  • Pretend to be someone else or provide inaccurate information
  • Distribute spam or send mass emails to the service users or administration
  • Violate any intellectual property rights of third parties
  • Interfere with our services or create an unacceptably high load on our website
  • Store any information about service users without their consent

Geographical Restrictions

Users who are residents of, or are accessing the platform from, following countries and regions are prohibited from accessing or using our services: Afghanistan, Albania, Barbados, Belarus, Bosnia and Herzegovina, Burkina Faso, Burundi, Cambodia, Cayman Islands, Central African Republic, Cuba, Democratic Republic of the Congo, Gibraltar, Guinea, Guinea-Bissau, Haiti, Iran, Iraq, Jamaica, Jordan, Lebanon, Libya, Mali, Morocco, Mozambique, Myanmar, Nicaragua, North Korea, Palestine, Panama, Philippines, Russia, Senegal, Somalia, South Sudan, Sudan, Syria, Taiwan, Tanzania, Turkey, Uganda, United Arab Emirates, Venezuela, Western Sahara, Yemen, Zimbabwe, the Crimea, Donetsk, Luhansk, Kherson and Zaporizhzhia regions of Ukraine, Abkhazia, and Gaza, or any other jurisdiction subject to UK, EU, OFAC, or UN sanctions

Prohibited Content

Channels containing any of the following content must not be offered for sale:

  • Illegal or criminal content
  • Pornographic or explicit material
  • Hate speech, violence, or threats
  • Extremist or terrorist content
  • Misinformation, political manipulation, or propaganda
  • Gambling or betting (unless legally licensed)
  • Compromised or stolen channels
  • Activities violating the terms of the original platform (e.g., YouTube Terms of Service)

Prohibited Social Media Manipulation

You must not sell social media engagement or manipulation services. Prohibited services include, without limitation:

  • Artificial increase of likes, followers, comments, shares, or views;
  • Automated engagement services, bots or scripts;
  • Any activity that manipulates platform metrics or violates the Terms of Service of social media platforms.

The platform permits only the sale of rights to Digital Assets, such as social media groups, pages and channels.

Member Accounts

Information supplied when creating an account must be accurate, complete and kept current. Providing information that does not meet these requirements breaches the Terms and may lead to immediate account termination.

You are responsible for keeping your access password secure and for all activities performed using it, whether it belongs to this Service or a third-party service.

Do not share your password with a third party. Notify us immediately if you discover a security breach or unauthorized use of your account.

We may suspend your account at any time, for any reason, in our sole and absolute discretion, with or without notice.

Listing Rules

It is forbidden to:

  • Add Digital Assets that you do not have access to, or do not want to sell
  • Add Digital Assets that do not fit into any category on the website
  • Add Digital Assets that violate copyrights, contain illegal content, incite enmity, or violate the rights of any third persons
  • Manipulate the price of Digital Assets and tamper with other users pricing policies

Listing Description Rules

Listing descriptions must be written exclusively in English. They may contain general information about the Digital Asset, including:

  • Detailed Digital Asset topics
  • Age of the Digital Asset
  • Digital Asset audience (age, gender, geolocation)
  • Digital Asset income
  • Digital Asset growth (number of subscribers per day/week/month)
  • Promotion methods used for this Digital Asset

Do not include the following in a listing description:

  • Digital Asset price (the price is entered in a separate box)
  • Any contact details (Buyers will message you via TradeMySocials)

Our administration may remove a listing at any time, for any reason, in its sole and absolute discretion, with or without notice.

Escrow Service

Every transaction started through the platform must use the TradeMySocials Escrow Service (the “Escrow Service”).

The Escrow Service is the required mechanism for structuring and supporting secure transactions between Buyers and Sellers.

TradeMySocials is not a licensed escrow agent, financial institution, payment service provider, or trustee.

“Escrow Service” is the platform’s commercial name for this mechanism. It does not imply the provision of a regulated escrow or financial service.

Apart from the service fee payable for providing the Escrow Service, TradeMySocials does not hold, store, safeguard or control funds belonging to Buyers or Sellers.

The Buyer pays the Seller directly for the Digital Asset, using the payment method agreed between them.

TradeMySocials acts only as a neutral intermediary for transaction steps, communication and, where applicable, assistance with dispute resolution. It is not a party to the Buyer’s and Seller’s Sale Agreement.

Under applicable law, this Escrow Service does not constitute a regulated escrow, payment, banking or fiduciary service.

Prohibited Transactions

Do not use the Site or Services for an illegal transaction, an illegal item or any illegal purpose.

Legal Relationship between Buyers and Sellers

The Digital Asset sale agreement (“Sale Agreement”) binds both parties once the Seller agrees to sell the asset and the Buyer agrees to purchase it.

A Buyer’s offer to purchase a Digital Asset is binding on that Buyer and cannot be revoked.

The offer does not bind the Seller until the Seller accepts it.

Payments

The Buyer is responsible for paying the Escrow Service fee.

We receive only the Buyer’s service fee for access to and operation of the Escrow Service. We do not receive, process or settle payments for Digital Assets.

The payment method you select may require an additional fee.

TradeMySocials may change TradeMySocials fees in its absolute and sole discretion. TradeMySocials is not responsible for payment of any sales, use, personal property or other governmental tax or levy imposed on any items purchased or sold through the Services or otherwise arising from the Transaction.

Cancelling a Transaction

We will notify each User if a Transaction cannot be completed for any reason, including our cancellation of it. We may cancel any Transaction at our discretion.

Refunds

Refunds are credited to your TradeMySocials balance.

Fees you have paid to TradeMySocials may be refunded where:

  • Any refund policy in the Rules entitles you to a refund; or
  • TradeMySocials is required by law or considers that it is required by law to do so.

Our decision on whether this clause requires a refund is final and conclusive and cannot be challenged by you.

Refunds take one to two weeks.

Questions about the Services

By filling out the customer service form or by writing to the administrator within the TradeMySocials system you may inquire about payments made through the Service. If you are sure that an error has been made or there has been any unauthorized use of your Account or the Services, you can send an e-mail immediately, or no later than 24 hours after you became aware of an error. When contacting TradeMySocials, please be prepared to report your name, TradeMySocials reference number and your email address you have registered on the TradeMySocials site.

Security

TradeMySocials uses a secure sockets layer (“SSL”), which is a security protocol. It provides data encryption, server authentication, and message integrity for connections to the Internet. Also, TradeMySocials has a security system that requires a user ID and a password to access your listings and transactions on the Site. It also has a unique method of encrypting the data that is transmitted during the TradeMySocials Escrow process.

Disclaimers

We do not guarantee a Seller’s claims or obligations concerning a Digital Asset.

We do not guarantee the number of likes or views associated with a Digital Asset you purchase.

We are not responsible for events after a listing ends or a sale completes. A sale is complete when the Seller receives the Buyer’s payment.

TradeMySocials expressly disclaims any and all express and implied warranties, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. TradeMySocials is not responsible for those guarantees, warranties, and representations, if any, offered by any Seller of items. No advice or information, obtained by you from TradeMySocials or through the Services, whether oral or written, shall create any warranty not expressly made herein.

Intellectual Property

Ownership of the Service and its original content, features and functionality remains exclusively with TradeMySocials and its licensors.

Links to Other Web Sites

The Service may link to websites or services belonging to third parties that we do not own or control.

TradeMySocials has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that TradeMySocials shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Review the terms and privacy policies of any third-party website or service you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Your right to use the Service ends immediately on termination. To terminate your account, you may discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

We work to keep the Services safe, secure and functioning properly, but cannot guarantee uninterrupted operation or access.

Your use of the Service is at your sole risk. The Service is provided on “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Without prejudice to the generality of the foregoing paragraph, trademysocials.com does not warrant that:

  • This website will be constantly available, or available at all; or
  • The information on this website is complete, true, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind. If you require advice concerning any legal or financial matter you should consult an appropriate professional.

TradeMySocials does not make any warranty to the underlying transaction or any items obtained by you through the use of the website or the services. TradeMySocials does not make any warranty that the services will meet your requirements, or that the services will be uninterrupted, timely, or error-free.

Limitations of Liability

TradeMySocials will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

  • To the extent that the website is provided free-of-charge, for any direct loss;
  • For any indirect, special or consequential loss; or
  • For any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if TradeMySocials has been expressly advised of the potential loss.

Other Parties

You agree that you will not bring any claim personally against TradeMySocials’s officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect TradeMySocials’s officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as TradeMySocials.

Unenforceable Provisions

If any provision of this website disclaimer is or is found to be unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Indemnity

You hereby indemnify trademysocials.com and undertake to keep TradeMySocials indemnified against any losses, damages, costs, liabilities and expenses (including, without limitation, legal expenses and any amounts paid by TradeMySocials to a third party in settlement of a claim or dispute on the advice of TradeMySocials’s legal advisers) incurred or suffered by TradeMySocials arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of These Terms and Conditions

Without prejudice to TradeMySocials’s other rights under these terms and conditions, if you breach these terms and conditions in any way, TradeMySocials may take such action as TradeMySocials deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Changes

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined in our sole discretion.

If you continue accessing or using the Service after revised Terms take effect, you agree to be bound by them. Stop using the Service if you do not accept the revisions.

Assignment

TradeMySocials may transfer, sub-contract or otherwise deal with TradeMySocials’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire Agreement

These terms and conditions, together with TradeMySocials’s Privacy Policy, constitute the entire agreement between you and trademysocials.com in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Law and Jurisdiction

The laws of England and Wales govern these Terms and their interpretation. Disputes relating to the Terms are subject to the exclusive jurisdiction of the courts of England and Wales.
